The 2-Year STNK Expiry: Is Vehicle Confiscation a Risk?

Recently, news has been circulating about vehicles being confiscated if the validity of the STNK (Vehicle Registration Certificate) expires for more than 2 years. This news is quite concerning and has generated pros and cons. Most people consider the regulation to be unreasonable and quite troublesome.


STNK is a document of vehicle registration and identification to prove ownership, vehicle operational legality, and tax payment.


It contains not only the owner’s name and vehicle identity but also a 5-year endorsement and an extension validity period.


Accordingly, the STNK must be renewed annually and every five years to update vehicle data, replace the old STNK and license plates, and fulfill tax payment obligations.


Vehicle owners who intentionally let their STNK expire for two years after its validity period will have their vehicle data deleted or blocked, and the vehicle becomes illegal and potentially confiscated.

Legal Basis

The policy regulating the STNK validity period of STNK is outlined in Article 1 and Article 43 of the Indonesian National Police Regulation (Perpol) Number 7 of 2021 concerning Registration and Identification of Motorized Vehicles (Regiden).


The regulation states that if a vehicle owner fails to renew their STNK for more than two years after its expiration, the vehicle’s registration and identification of the motorized vehicle may be deleted from the official system.


Article 74 of Law Number 22 of 2009 on Road Traffic and Transportation also regulates the sanction, namely, vehicle data deletion and confiscation.


Additional provisions are stated in Articles 84 and 85 of Perpol Number 7 of 2021, further regulating motor vehicle registration and identification.


However, before enforcing such sanctions, the police will issue a series of warning letters to notify the vehicle owner. These are given in three stages:

  • The first warning is issued three months before data deletion;

  • The second warning follows one month after the first; and

  • The third warning is issued one month after the second


If the vehicle owner responds and renews their STNK during this period, the vehicle data will be reactivated.


However, if there is no response within one month after the third warning, the police will proceed with deleting the vehicle data and may confiscate the vehicle.

So, the sanctions from this rule don’t immediately result in vehicle data deletion, nor will they lead to vehicle confiscation upon ticketing. The vehicle owner will receive the said 3 warnings first.


During the warning period, vehicle owners are expected to reactivate their STNK validity to prevent the vehicle from becoming illegal.
